Klippo – Terms of Service

1. Acceptance of Terms

By accessing or using the Klippo platform (“Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, please do not use the Service. These Terms constitute a binding agreement between you and Klippo.

2. The Service

Klippo provides an AI-powered system that analyzes live video streams to identify, generate, and suggest highlight clips and related content (“the Service”). The platform allows streamers, creators, and broadcasters to process their live streams and obtain social-media-ready clips, transcripts, and related assets. The Service is available on a Software-as-a-Service (SaaS) basis via our website and dashboard.

3. Eligibility

You must be at least 16 years old to use the Service. By registering, you confirm that:

• you have full legal capacity to enter into this agreement;
• all information provided during registration is accurate; and
• you will use the Service in compliance with these Terms and applicable laws.

4. Account Registration

To access the Service, you must create an account using your email address and/or by connecting your streaming platform (e.g., Twitch, YouTube, Kick). You are responsible for:

• maintaining the confidentiality of your credentials and stream key;
• all activities that occur under your account; and
• ensuring your use complies with the Terms of Service of your connected platform (e.g., Twitch).

Klippo shall not be held responsible for unauthorized access resulting from your negligence.

5. User Responsibilities

You agree not to:

• use the Service for unlawful, defamatory, or harmful purposes;
• process or distribute copyrighted material without authorization;
• attempt to reverse engineer, copy, or modify any part of the software;
• share or reuse stream keys without permission; or
• use the Service to impersonate others or violate third-party rights.

Violation of these rules may result in immediate suspension or termination of your account.

6. Stream Data Processing

By using Klippo, you grant the Company limited rights to receive, process, and temporarily store your live stream data (video, audio, chat, and metadata) for the purpose of:

• detecting key moments;
• generating clips, transcripts, and related assets; and
• displaying such content in your personal dashboard.

You retain full ownership and copyright over your original video content. Klippo only processes this data temporarily and does not claim any rights over your streams. All clips and generated outputs remain accessible only to you and are automatically deleted according to our data retention policy (see Privacy Policy).

7. AI-Generated Content

Klippo uses artificial intelligence (AI) models (including Google Gemini) to analyze streams and generate highlight suggestions. AI-generated outputs (clips, captions, summaries, articles) are automated suggestions and may contain inaccuracies or biases. By using the Service, you acknowledge that:

• AI outputs are provided “as-is”;
• You remain solely responsible for reviewing, editing, and publishing them; and
• Klippo assumes no liability for errors, omissions, or damages arising from AI results.

8. Payments & Subscriptions

Access to Klippo may include free and paid subscription plans. Prices, features, and billing cycles will be displayed on the website and may vary based on usage (e.g., hours processed). Payments are handled securely through third-party providers (e.g., Stripe, PayPal). We do not store payment data directly. You agree that:

• subscription fees are billed in advance;
• refunds, if applicable, follow the policy stated on the payment page; and
• unpaid accounts may be suspended until payment is received.

9. Intellectual Property

All rights, titles, and interests in the Klippo platform, including the software, code, AI models, designs, and trademarks, belong exclusively to the Company or its licensors. Users retain ownership of their original content and clips. By using Klippo, you grant us a limited, non-exclusive license to process your data for providing the Service. Any feedback, ideas, or suggestions you submit may be used by Klippo without obligation or compensation.

10. Data Protection & Privacy

Your use of the Service is subject to our Privacy Policy, which complies with the EU General Data Protection Regulation (GDPR). By using Klippo, you consent to the collection and use of data as described therein. We process personal data only for legitimate purposes, and all data transmissions are encrypted via TLS/HTTPS.

11. Third-Party Integrations

Klippo integrates with third-party APIs and platforms such as Twitch, YouTube, Kick, Google Gemini, AssemblyAI, and AWS. Each integration is subject to its respective terms and conditions. Klippo is not responsible for downtime, data loss, or policy violations originating from third-party services.

12. Limitation of Liability

To the fullest extent permitted by law, Klippo and its affiliates shall not be liable for:

• any loss of data, profits, or revenues;
• indirect, incidental, or consequential damages;
• interruptions or technical failures beyond our control; or
• damages caused by third-party misuse, software errors, or AI inaccuracy.

Total liability shall not exceed the total amount paid by the user during the preceding 12 months.

13. Termination

We may suspend or terminate your account if:

• you breach these Terms or applicable law;
• you misuse or attempt to exploit the platform; or
• required by law or third-party platform policy (e.g., Twitch).

You may delete your account at any time from the dashboard or by emailing us at klippo.help@gmail.com. Upon termination, all user data will be deleted according to our retention policy.

14. Dispute Resolution & Governing Law

These Terms are governed by the laws of Italy. In case of disputes, the exclusive jurisdiction shall be the Court of Milan (Tribunale di Milano). Before pursuing any legal action, both parties agree to attempt an amicable resolution through mediation.

15. Modifications

We may modify or update these Terms at any time. Changes will take effect upon publication on the website. Continued use of the Service constitutes acceptance of the new Terms.
